Failure to diagnose heart condition leads to delay in care

When a trip to a medical facility fails to result in an accurate or complete diagnosis, the condition of a patient in Illinois may be left untreated for extended periods. Even if the condition is properly diagnosed in the future, the results of a delay in treatment could have a significant impact on one's health. An appeals court in another state has recently affirmed the initial ruling of a lower court during the appeal of a medical malpractice claim in which a failure to diagnose a heart condition left a man with serious injuries.

The incident reportedly began when the man visited a medical facility to undergo a stress echocardiogram. The test was initiated due to the presence of a history of coronary artery disease within his family, and he claims that he was told that the results of the test were normal. However, he was admitted into the hospital with shortness of breath nearly one year later and asserts that he was diagnosed with non-ischemic cardiomyopathy.

The lawsuit asserts that negligence during his initial testing caused his condition to deteriorate and forced him to go months without the necessary treatment. During court proceedings, he was awarded a judgment of over $3 million. Although the facility choose to appeal the decision, the appeals court reportedly upheld the initial ruling of the lower court.

A failure to diagnose a serious condition can have a devastating impact on a person's well-being. Those who suffer serious harm due to such negligence could choose to consult with an attorney for guidance on all their available legal avenues. An attorney can provide a client in Illinois with assistance in pursuing the full amount of compensation deserved, whether with the filing of a medical malpractice claim or during the appeal of the initial decision.
