Wife and mother files wrongful death claim after husband's death

On Sept. 14, 2011, a husband and father was admitted to the hospital. By Oct. 20, 2011, he was dead. His wife believes that doctors failed to appropriately diagnose and treat her husband, which led to his death. It may not surprise many Illinois residents that, in June of this year, she filed a wrongful death claim on behalf of their children, herself and her husband's estate.

Judge says parents can seek punitive damages for wrongful death

Too many parents in Illinois will understand the pain an out-of-state couple felt when they lost their baby just 43 days after he was born. The couple filed a wrongful death suit against the medical center and their baby's doctor, alleging fraud, battery and gross negligence. Recently, the judge presiding over the case gave the parents permission to seek punitive damages from the medical center.
