Does an emergency room death equal a wrongful death claim?

The answer is that it could be, depending on the circumstances. Illinois emergency room personnel do the best they can under sometimes harrowing and heartbreaking circumstances, but that fact does not excuse mistakes that cost people their lives. If you believe that your loved one died because of an error in the emergency room, you may be entitled to file a wrongful death claim against the person or persons who provided substandard care to your loved one, along with the medical facility.

The members of that jury decided that a failure to diagnose the man's cancer in a timely manner did, in fact, lead to his premature death. His family was awarded approximately $7 million in damages.
