Guardianships for Victims of Medical Malpractice

A guardianship may be appropriate to protect the financial interests of an incapacitated person to ensure the personal well-being of an individual who is unable to care for himself or herself. Guardianships are also established to protect the money received by children, whether for their own injuries or money received for the death of a parent or sibling. Guardianships are required by law in these circumstances. The court will require that a guardian be appointed to manage the money received by children and disabled adults (usually a financial institution).
